License your trademark

You as the trademark owner may grant someone else a licence to use your mark. This means that although you retain the ownership of the mark, another company or person is given the right to use it. The licensor and the licensee should agree with each other on the details concerning the conditions of and the compensation for the use.

The licence may be exclusive or non-exclusive. It may cover the whole registration or be restricted to cover only a part of its goods or services. The licence may also be limited to a geographical area.

Entry in the Finnish Trademark Register

Licences should be recorded in the Finnish Trademark Register in order to make them public. A non-registered licence will not affect a third party who has obtained the trademark right in good faith.

The application to record a licence can be submitted either by the trademark owner or by the licensee. The licence can be recorded already at the application stage or any time during the term of registration.

The application must include the following details and documents:

  • registration number of the trademark
  • name, domicile or registered office, address and Business ID of the licensee. If the licensee is a private person, give their personal identity code. If the licensee has no Finnish personal identity code, give their date of birth.
  • name, domicile or registered office, address and Business ID of the representative, if any. If the representative is a private person, give their personal identity code. If the representative has no Finnish personal identity code, give their date of birth.
  • date of the licence agreement, and its restrictions, if any
  • copy of the licence agreement.
