Changes to patent, SPC and utility model fees from 1 January 2024

The Ministry of Economic Affairs and Employment of Finland has issued a new decree on the chargeable services of the PRH (1247/2023) for the period 1 January to 31 December 2024.

The changed patent, SPC and utility model fees are provided below. The earlier fee is given in brackets.

Application fees for patents

• Application fee
• the online filing system is used €430 (earlier fee €400)
• the online filing system is not used €540 (€500)
• Publication fee
• the translation has been filed using the online filing system €430 (€400)
• the translation has not been filed using the online filing system €540 (€500)
• for correction of a translation €540 (€500)
• Translation fee €80 per page (€70 per page)
• Reinstatement fee
• first reinstatement €90 (€70)
• subsequent reinstatements €160 (€140)
• Additional fee for a further period under section 31, subsection 2 of the Finnish Patents Act €140 (€125)
• Special additional fee in cases where the application is pursued according to section 31, subsection 1 or section 38, subsection 2 of the Finnish Patents Act (550/1967), and the application includes an invention that has not been the subject of an international search or international preliminary examination, and the provisions of section 36 or 37 of the Finnish Patents Act are not applicable. €540 (€500)

Fees for validating a European patent in Finland

Transitional provisions

As a rule, the applicable fee is determined by the date of payment.

Exceptions:

• The application fee and registration fee are determined by the date of receipt of the application.
• The publication fee of a national patent application is paid according to the communication under section 19 of the Finnish Patents Act.
• The reinstatement fee is paid according to the dismissal decision.
• The annual fee for patents or the renewal fee for utility models is determined by the due date. If you pay the annual fee or renewal fee late, the fee raised by 20% is determined by the due date of the original annual fee or renewal fee. Annual fees and renewal fees that are paid in 2023 will however be considered paid according to the price list for 2023, regardless of due date.
