Purpose of and legal basis for processing personal data

The processing is necessary to comply with the controller’s legal obligation. Under section 16 of the Finnish Enterprise Mortgage Act, enterprise mortgage matters are processed by the Finnish Patent and Registration Office (registration authority). The registration authority keeps the Finnish Register of Enterprise Mortgages, which is a shared register for the entire country.

Personal data and categories of data subjects in the register

A mortgage may be registered on the movable property belonging to the enterprise of a trader recorded in the Trade Register and the property may be pledged as a security for a debt, without transfer of possession, in accordance with the Enterprise Mortgage Act. The trader can be a legal person or a natural person. The trader’s name and Business ID are entered into the Register of Enterprise Mortgages as they have been entered into the Trade Register. The party applying for the mortgage can be the enterprise itself or the mortgage holder.

The details laid down in the Enterprise Mortgage Act on the confirmed mortgage are entered into the register along with the information listing the holder of the promissory note secured by a pledge and the holder’s address, which are submitted to the registration authority. If the holder of the promissory note secured by a pledge is a natural person, the holder’s name and mailing address reported as the holder’s contact address are entered into the register.

The mortgage holder’s personal identity code or home address does not have to be reported, and neither of them is entered into the Register of Enterprise Mortgages. Documents containing personal identity codes are partially classified as confidential in the electronic archive.

Notifications contain information on the applicant (the enterprise itself or an agent with contact details). Enclosed documents may contain details on enterprise owners and persons who have participated in meetings.

Sources of information

The details are entered into the Register of Enterprise Mortgages based on an application submitted by the applicant (usually the enterprise itself or the credit institution to which the pledge has been transferred).

Under section 35 a of the Enterprise Mortgage Act, courts of law must send the registration authority copies of their decisions in appeal matters concerning enterprise mortgages.

Disclosure of personal data to third parties

Under section 35 of the Enterprise Mortgage Act, anyone is entitled to obtain information about the entries made in the Register of Enterprise Mortgages and related documents.

Details can be obtained online from the Virre Information Service, by ordering extracts, certificates and documents, and by telephone inquiry. Contract clients have registered data directly delivered to their application through a technical interface. Notifications and enclosures submitted by enterprises can be studied at the PRH in Helsinki.

The personal identity code or the home address does not have to be reported, and neither of them is entered into the Register of Enterprise Mortgages. Documents containing personal identity codes are not disclosed automatically. If such documents are requested, the personal identity codes will be masked in the documents to be disclosed.

The reported name and contact details (address) of the agent and the holder are shown in public documents.

Transfer of personal data to countries outside the EU or the EEA or to international organisations

No data is transferred to countries outside the EEA.

Storage periods of personal data

The storage periods of the personal data in the Register of Enterprise Mortgages are based on a filing plan which allows the data to be stored permanently.

Profiling and automated decision-making

The data in the Register of Enterprise Mortgages are not used for profiling.

Right of access to personal data

The data subject has the right to check what personal data about them have been entered into the register, or to find out that there are no such register entries. The data subject can ask the controller for access to their personal data. Read our instructions on how to request access to data.

Right to rectification of data

The data subject has the right to demand that the controller rectify without undue delay any inaccurate or incorrect personal data concerning them. Read our instructions on rectification of data.

Right to restriction of processing

The data subject has the right to demand that the controller restrict the processing of data, if the data subject contests the accuracy of the personal data. The idea is to restrict the processing for a period during which the controller can verify the accuracy of the personal data.

Right to deletion of data

The right to deletion (‘right to be forgotten’) does not apply to the Register of Enterprise Mortgages, which is regulated by law.

Right to lodge complaint with supervisory authority

The data subject has the right to lodge a complaint with the supervisory authority (the Data Protection Ombudsman).
