How to appeal against decisions of the PRH

Appeals against decisions taken by the Finnish Patent and Registration Office (PRH) are lodged with the Market Court Open link in a new tab or the Administrative Court of Helsinki. Open link in a new tab The Market Court deals with and makes decisions on appeals about industrial property rights and the Trade Register. Decisions on associations and foundations as well as other decisions taken by the PRH may be appealed against to the Administrative Court of Helsinki.

Decisions taken by the PRH may be appealed against to the Market Court where decisions have been taken on the following matters

  • patents
  • utility models
  • layout-designs of integrated circuits
  • trademarks
  • designs or
  • refusal of registration of a notification filed with the Trade Register.

Appeal instructions are provided with the the PRH’s decision being appealed against. The appeal must be made to the Market Court within 60 days after service of the decision.

You may appeal against the decision of the PRH by lodging an appeal to the Administrative Court of Helsinki where any one of the following has been refused by the decision

  • registration of a notification filed with the Register of Associations,
  • an application for permission to establish a foundation,
  • an application for the ratification of the rules of a foundation, or
  • registration of a notification filed with the Register of Foundations.
  • In addition, the Administrative Court of Helsinki processes the appeals against the decisions taken by the PRH, except for the issues intended for the Market Court unless otherwise provided elsewhere.

Appeal instructions are provided with the PRH’s decision being appealed against. The appeal must be made to the Administrative Court of Helsinki within 30 days after service of the decision.
