Automated decision-making when notifications of termination of private traders are filed with the Finnish Trade Register

From 26 August 2024, the PRH may use automated decision-making in notifications to the Finnish Trade Register when private traders file notifications of termination of business with the register.

We do not register all notifications automatically. The notifications are handled by an officer in charge of the processing if they include details which do not meet the conditions for automated decision-making.

The conditions for automated decision-making are specified in our online filing service at ytj.fi and in our Trade Register processing system. The specifications are provided in the deployment decision and the processing rules.

When can notifications be processed automatically?

The PRH can automatically process notifications of termination if the notification was filed using the online service at ytj.fi in Finnish or Swedish.

In addition, the notification must meet the following conditions:

• The notification does not contain details that require case-by-case consideration.
• No enterprise mortgage has been registered on the private trader’s property.
• The notification is signed by a person entitled to sign the notification by law.
• We have no reason to suspect that the filed details are incorrect.

How do I know if a notification is processed automatically?

We send the company a Trade Register extract when the notification of termination has been processed. The extract shows if the registration was made automatically and where you can find more information about automated decision-making.

Can I appeal automated decision-making?

Traders cannot appeal against the use of automated processing for notifications of termination at the PRH. In addition, traders cannot appeal against the registration of details of notifications of termination at the Finnish Trade Register.

The PRH registers the termination of business based on the trader’s notification. In these cases, Finnish legislation does not require that an administrative review can be requested.

The PRH has assessed that automated decision-making does not put obliged companies or organisations in unequal positions.
