Amendments to the PCT Regulations as from 1 July 2020

On 1 July 2020, there will be amendments to the Regulations and the Administrative Instructions for the international PCT patent application system.

The amendments to the PCT Regulations will enable correction of patent applications in situations where erroneous elements or parts have been attached to applications by mistake. Under certain conditions, the applicant can replace the erroneous sheets by submitting the correct sheets, in which case the international filing date for the application will be the date when the corrections have been submitted (Rule 20.5bis).

The amendments will also enable the Finnish Patent and Registration Office (PRH), as a Receiving Office, to allow delays in meeting time limits due to the unavailability of electronic means of communication. If there is an interruption, the PRH will, among other things, publish information on the interruption on its website and notify WIPO of it in accordance with the Regulations (Rule 82quater.2).

In addition, the amendments will increase the number of the attachments that the PRH submits with the International Preliminary Examination Report (IPER) to WIPO. The documents to be attached to the IPER are specified in Section 602bis(a) in the Administrative Instructions. Together with the IPER, the PRH sends its written opinion on the patentability and the letters that the applicant has submitted to the PRH during the examination. The documents are published in WIPO’s PATENTSCOPE database.
